The predicate has never been applied refers to a span of time, from the writing of the Constitution to the present, rather than to a past event (as was does), and the phrase is required indicates that the provision still applies.
这句解释我不明白,我还以为是从 never上看出要用完成时态的,可是为什么og的解释说,是从is required看出呢?

它是说谓语has never been applied 值得是一段时间(从the writing of ...倒现在)而不是指过去的事件,is required 表明the provision 仍然实施着
