require that和 require to

for instance:

OG 138. Senator Lasker has proposed legislation requiring that employers should retain all older workers indefinitely
or show just cause for dismissal.
(A) that employers should retain all older workers
(B) that all older workers be retained by employers
(C) the retaining by employers of all older workers
(D) employers' retention of all older workers
(E) employers to retain all older workers

if the word"should" of the answer (A):"that employers should retain all older workers" was ejected , whether (A) would be the best answer in that (E) has changed the logical meaning of the original sentence?

The idiom "require that" invovies the subjunctive mood but does not "require to".

IS "require to " prior to "require that'?

A的should去掉的话A和E都是正确答案,分不出孰优孰劣。。。个人意见
